
According to the Washington Blade, a Fairfax County Circuit Court dismissed a lawsuit brought against the Fairfax County Public Schools board by the Liberty Counsel, a conservative legal nonprofit. The lawsuit claimed that the Fairfax County Public School Board’s decision to include sexual orientation and gender identity in its nondiscrimination policy violated the Dillon Rule, which is to prevent local governing entities from superseding state law. Currently, the Commonwealth of Virginia does not offer protection against discrimination based on sexual orientation or gender identity.
